Former Brazilian President Jair Bolsonaro was taken into federal police custody on Saturday, marking a dramatic escalation in his legal troubles as he continues to appeal a Supreme Court conviction linked to efforts to undermine Brazil’s democracy. His lawyer, Celso Vilardi, confirmed the detention to Reuters but declined to explain the grounds. A person with knowledge of the case said the move was a preventative measure tied to the conditions of Bolsonaro’s ongoing house arrest, which authorities believed he may have violated.
Federal police officials in BrasÃlia said the former president was undergoing standard intake medical examinations on Saturday morning as part of the detention process. Bolsonaro’s legal situation has steadily intensified since September, when he was sentenced to 27 years and three months in prison for orchestrating a plot to overturn the results of the 2022 election and prevent his successor, President Luiz Inácio Lula da Silva, from taking office. According to the court’s findings, Bolsonaro played a central role in the scheme and stood to gain the most from blocking the democratic transition.
Although he was convicted, a final arrest warrant has not yet been issued because Bolsonaro still has appeals pending before the Supreme Court. For more than three months, he has remained under strict house arrest in a separate case involving accusations that he sought help from US political allies to interfere with or halt legal proceedings against him. Under those restrictions, he was prohibited from using social media but was allowed to receive political visitors.
The case has drawn strong reactions abroad. Former US President Donald Trump—an ally during Bolsonaro’s presidency—has described the charges as a political persecution or “witchhunt.” In protest, Trump sanctioned Supreme Court Justice Alexandre de Moraes, who is overseeing several Bolsonaro-related investigations, and imposed a 50% tariff on selected US imports of Brazilian goods. Those tariffs began to be eased earlier this month.
Bolsonaro’s legal team is expected to petition the courts to allow him to continue serving any sentence under house arrest, citing a string of chronic health problems. The former president has undergone numerous surgeries since being stabbed in the abdomen during a 2018 campaign event—an injury that has led to recurring medical complications.
Bolsonaro, once a dominant figure on Brazil’s right, had already been barred from running for public office until 2030 after Brazil’s electoral court ruled that he abused presidential powers during the 2022 campaign. His detention now adds another layer of uncertainty to his political future and deepens Brazil’s ongoing reckoning with the events surrounding the tumultuous transition of power.
