A passport is a travel document, not a citizenship document: Government


The Ministry of External Affairs (MEA) has clarified that while passports are issued only to Indian citizens, a passport itself cannot be treated as definitive proof of citizenship. The clarification was made on the occasion of the 14th Passport Seva Divas.

The statement has sparked considerable discussion on social media, particularly regarding what documents can be considered conclusive evidence of Indian citizenship. The issue remains complex and has not been addressed through a single, universally accepted document by the government.

Passport Not a Citizenship Certificate

According to the MEA, a passport primarily serves as an official travel document that enables international travel. Although only Indian citizens are eligible to receive a passport, possession of one does not automatically establish citizenship as a legal fact.

The clarification has drawn attention because non-citizens are not granted Indian passports. However, the government maintains that the document’s primary purpose is travel facilitation rather than certification of citizenship status.

Additionally, passports are not regarded as personal property. A note printed inside the passport states that it remains the property of the Government of India and must be surrendered whenever required by the authorities.

Other Documents Also Not Conclusive

The clarification comes amid broader discussions about citizenship documentation in India. Earlier this year, during proceedings related to the Special Intensive Revision (SIR) of electoral rolls, the Supreme Court observed that Aadhaar cannot be considered conclusive proof of citizenship. It functions only as a document establishing identity.

Similarly, a voter identity card is not treated as evidence of citizenship. Its primary purpose is to serve as proof of identity and residence while enabling eligible individuals to vote during elections.

Citizenship by Birth Rules

Indian citizenship laws provide different criteria depending on an individual's date of birth.

A person born in India between January 26, 1950, and July 1, 1987, is automatically considered an Indian citizen by birth.

For those born after July 1, 1987, citizenship by birth is granted if at least one parent was an Indian citizen at the time of birth.

Individuals born on or after December 3, 2004, are eligible for citizenship by birth only if both parents are Indian citizens, or if one parent is an Indian citizen and the other is not an illegal immigrant when the child is born.

Expansion of Passport Services

Alongside the clarification, the MEA highlighted significant progress in passport-related services across the country, including the successful implementation of chip-enabled e-passports.

The ministry reported that in 2025, around 1.5 crore passport and related services were delivered, with passports accounting for approximately 1.39 crore of those services.

Officials also noted improvements in processing efficiency. Passports are now being issued within an average of six working days, excluding the time required for police verification. Citizens visiting Passport Seva Kendras reportedly spend less than 45 minutes on average at service centres.

According to the MEA, these improvements have been made possible through a substantial expansion of the passport service network. India currently has 545 passport service centres, a significant increase from just 77 centres a decade ago.
