Satya Niketan fall and the Malviya Nagar fire: Why do the same officials take different actions


Two of the five Municipal Corporation of Delhi (MCD) South Zone officials facing action over the Satya Niketan hostel collapse were also serving in the civic body when the Malviya Nagar hotel fire claimed 23 lives on June 3.

Deputy Commissioner Rakesh Kumar and Superintending Engineer Ranvir Singh are among the officials against whom action has now been taken following the Satya Niketan tragedy.

What has drawn attention is that neither official faced action after the Malviya Nagar incident, whereas both were suspended with immediate effect following the Satya Niketan collapse. The contrasting responses have raised questions about differences in MCD accountability and the responsibilities assigned to its officials in the two cases.

Experts have noted that both incidents highlight the dangers associated with residential buildings being illegally converted for commercial purposes. Several structures in Satya Niketan have reportedly been altered from ground-plus-one buildings into three- or four-storey properties. The building that collapsed was among them, leaving at least seven people dead and several others injured.

A similar situation existed in the Malviya Nagar case, where the hotel had originally been a residential structure before being converted into a commercial hospitality establishment.

Experts have further warned that illegally repurposed residential buildings can become particularly vulnerable when heavy rain coincides with construction or structural work. Both conditions existed in the Satya Niketan case, with renovation work taking place in the basement after overnight rainfall.

The central question, however, remains why the same officials were not held accountable after the Malviya Nagar fire but were suspended immediately after the Satya Niketan collapse. Another key issue concerns the exact responsibilities of these officials.

WHAT WAS THE DIFFERENCE BETWEEN THE MALVIYA NAGAR AND SATYA NIKETAN INCIDENTS?

The Malviya Nagar incident, which occurred in the Hauz Rani area, involved a fire at a restaurant where people were present. The incident was primarily linked to fire safety and health-related issues.

Following the fire, the MCD's health department came under scrutiny. Assistant Public Health Officer Prince Mann was suspended, while the Deputy Health Officer was transferred from the South Zone to the MCD headquarters at Civic Centre.

However, officials from the South Zone building department were not held responsible and no action was taken against them at that time.

WHY WAS THE SITUATION DIFFERENT IN SATYA NIKETAN?

Construction and renovation work was underway at the Satya Niketan building when it collapsed, bringing the MCD's building department directly under scrutiny.

Whenever construction, structural alterations or renovation work is carried out, officials at various levels of the MCD building department are expected to monitor such activities.

This explains why the action following the Satya Niketan incident extended beyond a single official. Responsibility was examined across multiple levels, from the Junior Engineer to the Superintending Engineer and Deputy Commissioner.

The first level involves Junior Engineer Ashish Kumar, who is considered the building department's ground-level official in the area.

When new construction, unauthorised construction or significant alterations are taking place, the JE plays an important role in visiting the site and monitoring the work.

WHAT WERE THE JUNIOR ENGINEER'S RESPONSIBILITIES?

  • Monitoring construction activity taking place in the area.

  • Conducting periodic inspections of construction sites.

  • Verifying whether construction complies with approved regulations.

  • Examining the materials being used and the progress of construction.

  • Informing senior officials about unauthorised or rule-violating construction.

  • Initiating steps to stop construction wherever necessary.

  • Taking action under the MCD's prescribed procedures in cases involving unauthorised construction.

The key question in the Satya Niketan case is whether the JE inspected the property while renovation work was underway.

If an inspection took place, authorities will need to establish what was discovered.

If violations were found, another question is why the work was not stopped before the building collapsed.

RESPONSIBILITY OF THE ASSISTANT ENGINEER

The next level involves Assistant Engineer Sunil Chauhan. The AE is also responsible for monitoring construction activity and taking forward action on irregularities identified by the JE.

Role of the AE

  • Inspecting construction activities in the area.

  • Reviewing reports submitted by the JE and assessing the situation at the site.

  • Verifying whether construction work follows applicable regulations.

  • Advancing action against unauthorised construction or renovation.

  • Initiating procedures such as booking a property or registering an FIR where necessary.

  • Ensuring that complaints or information about unauthorised construction result in actual action rather than remaining limited to official paperwork.

The important issue at this level is whether the MCD building department knew about the renovation work at the Satya Niketan property.

If officials were aware of it, why was timely action not taken?

RESPONSIBILITY OF THE EXECUTIVE ENGINEER

The next level in the hierarchy is Executive Engineer Lalit Kumar Goel.

The EE is senior to the JE and AE and has an important role in supervising building-related enforcement and monitoring within the area.

Role of the EE

  • Supervising the functioning of the building department in the area.

  • Reviewing reports concerning unauthorised construction.

  • Ensuring that action continues after a property has been booked.

  • Monitoring whether enforcement measures are properly implemented.

  • Advancing proceedings when demolition or other enforcement action is initiated.

  • Overseeing inquiries into complaints involving irregularities, bias or shortcomings in departmental action.

Essentially, when a construction violation is identified at the JE or AE level, the matter moves up the administrative chain. The EE is responsible for ensuring that the required action is effectively pursued.

RESPONSIBILITY OF THE SUPERINTENDING ENGINEER

Above the EE is Superintending Engineer Ranvir Singh, who has a broader supervisory role over the building department in the area.

Role of the SE

  • Supervising construction activity across the area.

  • Reviewing the work carried out by subordinate engineers.

  • Monitoring cases involving unauthorised construction.

  • Ensuring that procedures are properly followed at the JE, AE and EE levels.

  • Reviewing serious cases and departmental action at both site and administrative levels.

  • Ensuring that significant irregularities are brought to the attention of senior authorities and that appropriate action follows.

Therefore, the inquiry is not restricted to whether the JE inspected the property. It also raises questions about why officers at higher levels did not identify or address any lapses through their own supervisory mechanisms.

RESPONSIBILITY OF THE DEPUTY COMMISSIONER

At the highest level of the chain is South Zone Deputy Commissioner Rakesh Kumar.

The DC oversees the administrative functioning of various MCD departments within the zone and supervises important matters and actions.

In building-related cases, the zonal administration is expected to monitor enforcement measures and ensure that the relevant administrative procedures are being followed.

Role of the DC

  • Supervising the functioning of different MCD departments within the zone.

  • Reviewing significant and serious matters.

  • Monitoring actions undertaken by the building department.

  • Overseeing demolition and enforcement-related orders and proceedings.

  • Ensuring that departmental officials comply with established rules.

  • Ensuring that serious negligence is escalated to senior authorities and that appropriate action is initiated.

The Satya Niketan case therefore raises questions about the functioning of the entire chain of responsibility.

Following the incident, the MCD took the unusual step of holding officials at multiple levels accountable. Five officials, ranging from the Junior Engineer to the Deputy Commissioner, were suspended.

This indicates that the inquiry is not simply focused on identifying the official who may have inspected—or failed to inspect—the property. It is also examining whether negligence occurred at different stages of the administrative and engineering hierarchy.

DIFFERENT ACTION IN MALVIYA NAGAR, DIFFERENT PICTURE IN SATYA NIKETAN

This is the most notable distinction between the two incidents.

Malviya Nagar incident

One of the key messages emerging from the action following the Satya Niketan collapse is the emphasis on accountability.

The objective is to make clear that when construction rules are violated and officials fail to intervene in time, responsibility may not rest solely with a junior-level officer.

Accountability can extend throughout the administrative hierarchy.

That is why disciplinary action in this case extended from the Junior Engineer all the way to the Deputy Commissioner.
