UP Man sends shopkeeper a note after missing his relative's wedding because of his ruined shoes


A resident of Fatehpur in Uttar Pradesh, Gyanendra Bhan Tripathi, has taken legal action against a shopkeeper following the purchase of shoes from his establishment, which subsequently tore. In his formal notice, Tripathi asserted that the torn shoes prevented him from attending his brother-in-law's wedding, causing him significant mental distress and necessitating medical treatment at a hospital in Kanpur.

Tripathi, who practices law, recounted purchasing the shoes from Salman Hussain's store on November 21 the previous year. According to Tripathi, Hussain assured him that the shoes belonged to a reputable brand and were covered by a six-month warranty. However, within a mere six days of purchase, the shoes reportedly tore, resulting in Tripathi's inability to participate in his brother-in-law's wedding.

Attributing considerable mental strain to this incident, Tripathi disclosed seeking medical care at a private hospital. Subsequently, on January 19, he dispatched a notice to the shopkeeper, demanding reimbursement totaling Rs 10,000 for medical expenses, Rs 2,100 for legal registry fees, and Rs 1,200 for the cost of the shoes.

Additionally, Tripathi cautioned the shopkeeper of impending legal action should his demands remain unmet. In response, Salman Hussain acknowledged Tripathi's purchase from his store but refuted any allegations of misrepresentation regarding the shoe's brand.

Hussain clarified that Tripathi availed a 50 percent discount on the shoes and contended that despite the warranty assurance against sole damage within six months, no such incident occurred. Asserting the frivolous nature of Tripathi's accusations, Hussain denounced the attempts to coerce him into compensating, labeling the allegations as unfounded.
