How long are guests allowed to stay in the United States? The embassy explains when a visa expires


Amid the Donald Trump administration’s intensified focus on immigration enforcement, the US Embassy in India has reiterated an important clarification regarding how long international visitors are permitted to stay in the United States. The embassy stressed that the duration of stay is not linked to the visa’s expiry date, a misunderstanding that continues to cause confusion among travellers.

In a post shared on X, the US Embassy reminded visitors that the length of time they are authorised to remain in the United States is determined by a Customs and Border Protection (CBP) officer at the port of entry, not by the date printed on their visa. The embassy advised travellers to verify their permitted stay by checking the “Admit Until Date” on their I-94 record through the official website.

This is not the first time such a clarification has been issued. The embassy had released a similar reminder around two months ago, underlining the need for travellers to be aware of the distinction between visa validity and authorised duration of stay, especially in the current climate of stricter immigration scrutiny.

The I-94 form, which is mandatory for most foreign visitors entering the United States, contains the “Admit Until Date” that specifies the final day an individual is legally allowed to remain in the country. Importantly, this date may differ from the visa’s expiration date, as it is set at the discretion of the Customs officer upon arrival, based on the traveller’s visa category and purpose of visit.

According to the US Department of Homeland Security, foreign nationals arriving by air or sea are automatically issued an electronic I-94 by the CBP officer, eliminating the need to separately apply for the document online. However, individuals entering the US by land or through select ferry crossings are required to apply for a provisional I-94 online in advance, a step designed to streamline processing and reduce wait times at the border.

The department also clarified that certain categories of travellers are exempt from the I-94 requirement. These include US citizens, returning lawful permanent residents, individuals holding immigrant visas, and most Canadian citizens who are visiting or transiting through the United States.

The renewed emphasis on understanding visa rules and entry conditions aligns with President Trump’s broader approach to border control and immigration enforcement, which he has consistently framed as essential to national security. The 79-year-old President recently imposed travel bans on nationals from 19 countries, including Afghanistan and Syria, citing concerns such as terrorism, visa overstays and systemic corruption as justification for the move.
