A sessions court in Lahore has sought a detailed report from Pakistan’s Federal Investigation Agency after a petition was filed seeking the registration of a First Information Report against Indian national Sarabjit Kaur and Pakistani citizen Nasir Hussain for alleged violations of immigration and visa laws.
The petition was moved by advocate Ali Changezi Sandhu on behalf of former Pakistani Sikh legislator Mahinder Pal Singh. Filed under Sections 22-A and 22-B of Pakistan’s Code of Criminal Procedure, the plea requests the court to direct law enforcement agencies to initiate criminal proceedings against both individuals. Singh has earlier approached the Lahore High Court, where he raised concerns about Kaur’s presence in Pakistan and even alleged that she could potentially be an “Indian spy.”
According to the petition, Sarabjit Kaur entered Pakistan on November 4, 2025, as part of a group of Sikh pilgrims who had travelled to attend celebrations marking the birth anniversary of Guru Nanak. Her entry was facilitated through a pilgrimage visa, which, as per official records cited in the plea, was valid only until November 13, 2025. While the rest of the pilgrims returned to India after completing their religious visit, Kaur allegedly remained in Pakistan beyond the permitted period, thereby violating the terms of her visa as well as provisions of the Foreigners Act, 1946.
The plea further alleges that shortly after arriving in Pakistan, Kaur left Gurdwara Nankana Sahib and travelled with Nasir Hussain. It claims that Hussain subsequently married her and played an active role in facilitating her continued stay in the country by providing accommodation, transport, and other forms of assistance. These actions, the petitioner argues, amount to aiding and abetting an illegal overstay and constitute a breach of Pakistan’s immigration framework.
Urging strict action, the petitioner has asked the court to order the immediate registration of an FIR against both Kaur and Hussain so that their alleged illegal acts can be dealt with under Pakistani law. The plea also stresses that such action is necessary to uphold the integrity and sanctity of the pilgrimage visa regime, which is meant strictly for religious visits and not for permanent or prolonged stays.
Taking cognisance of the petition, Sessions Judge Shafqat Shahbaz Raha issued notices to the Director and the Investigation Officer of the FIA’s Immigration Wing. The court has directed the agency to submit a comprehensive report addressing the allegations, including details of Kaur’s alleged overstay after November 13, 2025, the supposed violation of visa conditions under the Foreigners Act, and the specific role attributed to Hussain in assisting her stay. The matter has been listed for further hearing on January 30.
Sarabjit Kaur, 48, was one among nearly 2,000 Sikh pilgrims who crossed into Pakistan via the Wagah border in November to participate in religious festivities. While the majority of the pilgrims returned to India within a few days, Kaur did not. Pakistani officials have stated that she married Nasir Hussain, a resident of Sheikhupura district, located about 50 kilometres from Lahore, just a day after her arrival in the country.
According to reports by Press Trust of India, the couple had earlier approached the Lahore High Court, which reportedly directed authorities not to harass them. Despite this, they were later taken into custody by Punjab Police. Following her detention, Kaur was placed in a government-run shelter home in Lahore, where she remains as the legal proceedings continue.
